Developing and implementing a tobacco-free policy sends a clear message that an organization values a tobacco-free lifestyle. A similar message can – and should be sent by local governments. Many municipalities have passed smoke-free by-laws in Ontario to meet the needs of their community and strengthen existing provincial legislation.

For example, prior to Smoke-Free Ontario Act (SFOA), that came into effect on May 31, 2006, local municipalities around the province passed local by-laws for smoke-free indoor and enclosed public spaces and workplaces. Once again, municipalities are in a position to show leadership in protecting the health of its citizens by establishing smoke-free outdoor spaces. The Municipal Act and the SFOA both state that whichever legislation is stronger, whether it be at the municipal or provincial level, it is the one that takes precedence locally.
